Service Users, relatives and friends
Moundsley Hall provides residential, nursing and respite care.
This notice explains how Moundsley Hallcollects, uses and maintains the information it holds about an individual; how the information is used, shared and how Moundsley Hall maintains the confidentiality of all its service users, relatives and friends.
When do we collect personal data?
When the term ‘personal data’ is referred to, it means that information that can or has the potential to identify someone as an individual.
Moundsley Hall will collect and process personal data about an individual in the following ways:

By providing us with any data described as above, this is done so voluntarily. If an individual chooses not to provide any of the data requested, this may affect the ability of Moundsley Hall to enter into contractual agreements with an individual.

We do not authorise these service providers to use or disclose the information except as necessary to perform services on our behalf or comply with applicable legal obligations.
Where a third-party data processor is used, we ensure that they operate under contractual restrictions with regard to confidentiality and security, in addition to their obligations under Data Protection Laws.

Information collected via the provision of healthcare
The information collected by Moundsley Hall via the provision of healthcare provided, may be classed as ‘sensitive information’. This may include third parties who are involved in the treatment or care of the individual. This disclosure will only occur in accordance to UK law, GDPR and professional guidelines.
GP & other medical professionals that we work with |
We may share clinical information with medical professionals wherein it is advisable and/or beneficial to the ongoing medical oversight, treatment and review of the individual. |
External practitioners |
We may share clinical and/or administrative information with any external practitioners that an individual is referred to. |
The NHS |
Wherein an individual may need to attend an NHS organisation (e.g. hospital, clinic), we may share clinical information about the care and treatment the individual is receiving to assist the NHS in assessment, treatment and review. |
Care Home Regulators |
We may share information with overseeing bodies that, as a care facility, we report to. In many cases, this is a requirement (e.g. Care Quality Commission). |
How we protect personal data
We ensure that all personal data is collected, collated and destroyed in an appropriate manner. We ensure that information sharing is limited to where only necessary. We ensure that all organisational and technical measures are in place to safeguard unauthorised, unlawful or accidental disclosure of personal information.
Retention
We retain personal data in line with the guidance set out within the ‘Records Management Code of Practice for Health and Social Care’ (2016).
Rights as a data subject
Any individual that we hold personal information on, have the following rights:
- Right to access; the individual has the right to request a copy of the information that we hold about them.
- Right of rectification; the individual has the right to correct any data that we hold that may be incorrect or inaccurate.
- Right to be forgotten; the individual has the right to request that their personal data be erased from our records. (This request will be subject to a review in line with GDPR, local authority and CQC guidelines).
- Right to restriction of processing; where applicable, the individual may request a limitation on the data we process regarding them.
- Right of portability; where applicable, the individual has the right to have the data we retain about them transferred to another organisation.
- Right to object; the individual has the right to object to certain forms of processing (e.g. for marketing purposes).
- Right to object to automated processing and profiling.

Making a complaint
